Terms of service
Last updated: 13 October 2026
These terms govern the use of OptimTask, offered by PON SOLUCIONES EMPRESARIALES, S.L. (tax ID B26784108, Calle del Convento Santa Clara, 1, 2.º, 3.ª, 46002 Valencia; hereinafter «the Provider») to companies and professionals («the Client»). By signing up a company or using the service, the Client accepts them.
1. The service
OptimTask is a web application for management and profitability analysis offered as a cloud service. The Provider grants the Client a non-exclusive, non-transferable right of use limited to the duration of the service. Features and improvements added to the single plan are included at no additional cost, unless expressly stated otherwise.
2. Sign-up and account
The company is signed up at the Client's request, and the Provider creates the company and its first administrator, who receives an invitation to set their password. The Client is responsible for the accuracy of the sign-up data, for the people it gives access to, for the permissions it assigns them and for safeguarding their credentials. It must report any unauthorised use without delay.
3. Free trial, read-only and suspension
- Free trial: 30 days from sign-up, with full access. The Provider may extend it.
- End of trial without subscribing: the company becomes read-only for 15 days: the Client can view and export its data, but not record or modify.
- Suspension: after that period, or if the service is suspended for non-payment or breach of these terms, access is suspended; the Client can still see the status of its account and export its data.
- In no case is the Client's data deleted simply because the company moves to read-only or suspended.
4. Price and billing
The plan is single: a fixed fee of €35/month per company plus €9/month per active user, always excluding VAT, which will be added at the applicable rate. An active user is any person in the company with access enabled; deactivated people do not count, nor do platform administrators. The fee may be reduced with promo codes assigned by the Provider. Billing takes place with the frequency and by the payment method agreed with the Client. Price changes will be notified with at least 30 days' notice and will not affect the period already billed.
5. Acceptable use
The Client agrees not to use the service for unlawful purposes, not to attempt to access other companies' data, not to circumvent security measures or technical limitations, not to run load or intrusion tests without written authorisation, and not to resell the service. The Provider may suspend access as a precaution in the event of use that endangers the security or availability of the service.
6. Client data and data protection
The data the Client enters into OptimTask is the Client's. With regard to the personal data it contains (its clients, contacts, employees…), the Client is the controller and the Provider acts as processor, with the obligations described in section 3 of the Privacy policy, which together with these terms constitutes the processing agreement required by Article 28 GDPR. The Client warrants that it has a legal basis to process that data and to entrust its processing to us. The Provider may, with prior notice, add or replace sub-processors.
7. Export, cancellation and deletion
The Client may export all of its data at any time from the application itself (Settings → Data), including when read-only or suspended. It may cancel the service at any time by written notice; the fee accrues until the cancellation takes effect. After the service ends, the Provider will keep the data for 90 days so the Client can recover it and will then securely delete it, unless there is a legal obligation to keep it.
8. Availability, maintenance and backups
The Provider provides the service with due professional care and makes regular backups, but does not guarantee uninterrupted availability or the absence of errors. It may interrupt the service for maintenance, trying to give advance notice and to do so at times of lower use. Support is provided by email at hola@ponsoluciones.com.
9. Intellectual property
The software, its design, documentation and trademarks belong to the Provider or its licensors. The Client keeps all rights over its data and grants the Provider only the licence necessary to provide the service.
10. Liability
The reports and figures of OptimTask are calculated from the data the Client enters; the Client is responsible for their accuracy and for the decisions taken with them. To the maximum extent permitted by law, the Provider's total liability to the Client for any cause is limited to the fees paid by the Client in the 12 months before the event giving rise to it, and the Provider is not liable for loss of profit or indirect damages. Nothing above limits liability that cannot be excluded by law, nor consumers' rights where applicable.
11. Changes
The Provider may amend these terms for legal, technical or service-improvement reasons, giving reasonable notice. If the Client does not agree, it may cancel the service without penalty before the change takes effect.
12. Governing law and jurisdiction
These terms are governed by Spanish law. For any dispute, the parties submit to the courts of Valencia, unless the applicable regulations establish a different mandatory jurisdiction.
